Marigney brought to arbitration by Scafati

Paul Marigney (192 cm, St. Mary’s, CA’05) was taken to arbitration at the Basketball Arbitral Tribunal (BAT) by his former team, Givova Scafati Basket (Italy-DNB). According to the arbitration, the club entered into a contract with the player for the 2012-13 season while still in an existing contract with them for the 2011-12 season. An advance payment of USD 10,000 was made to the player.

After the 2011-12 season Marigney informed the club that he did not wish to continue playing for them. Exchanges of communication were made from both parties regarding the situation and the club requested that a buyout resolution be undertaken. The claimants decided to seek abitration on the grounds that the player unilaterally terminated the contract without cause and refusing to play for the club in 2012-13.

The player did not respond to any of the requests for his reply at the BAT. The after deliberation and the application of the corresponding laws, the BAT has set the award for the arbitration as follows:

1. Mr. Paul Lester Marigney shall pay Scafati Basket S.r.l. an amount of USD 10,000 as reimbursement of monies due, plus interest at 5% per annum on such amount from 13 February 2012 onwards.

2. Mr. Paul Lester Marigney shall pay Scafati Basket S.r.l. an amount of USD 20,000 as compensation for damages, plus interest at 5% per annum on such amount from the date of this award onwards.

3. Mr. Paul Lester Marigney shall pay Scafati Basket S.r.l. an amount of EUR 6,966.50 as reimbursement for its arbitration costs.

4. Mr. Paul Lester Marigney shall pay Scafati Basket S.r.l. an amount of EUR 7,110 as a contribution to its legal fees and expenses.

5. Any other or further-reaching requests for relief are dismissed.
